Family-based green cards
Family-based green card: a U.S. citizen or permanent resident can petition for certain relatives. Immediate relatives of citizens have no annual cap.
01
Is this the right route?
A U.S. citizen or permanent resident starts with Form I-130, which costs $625 online or $675 on paper. Spouses, unmarried children under 21 and parents of adult citizens have no annual limit; other relatives wait for their Visa Bulletin date. The green card then comes by adjustment in the U.S. (Form I-485, $1,440 on paper) or at a consulate abroad. A USCIS memo of 21 May 2026 calls adjustment extraordinary, discretionary relief.
Who it's for Spouses, parents, children and siblings of U.S. citizens, and spouses and unmarried children of permanent residents.
Key requirements
- Form I-130: $625 online or $675 on paper
- Immediate relatives of citizens have no annual limit
- Other categories (F1 to F4) wait for the Visa Bulletin
- Form I-864: sponsor income of at least 125% of the poverty guidelines
02
How it works
The U.S. relative files Form I-130, online or by mail, and selects either adjustment in the U.S. or consular processing.
In preference categories, wait until the priority date is current in the Visa Bulletin.
In the U.S.: file Form I-485 with Form I-864 and the sealed medical exam, then attend biometrics and any interview.
Abroad: the National Visa Center collects fees and documents, the consulate interviews, and you pay the USCIS Immigrant Fee before travel.

Family-based green cards: questions people ask
How long does family-based green card processing take?
Family-based green card processing time depends on your category. Immediate relatives of U.S. citizens have no annual limit or Visa Bulletin wait, so only USCIS and consular steps count (Forms I-130, I-485); USCIS posts times by form. Other categories also wait for their date. Merit Law LLP checks the current chart.
How do I apply for a green card for my parents?
To get a green card for your parents, you must be a U.S. citizen aged 21 or older; parents of adult citizens are immediate relatives with no annual cap. File Form I-130 for each parent, $625 online or $675 on paper (October 2026). Each parent then adjusts status or processes abroad. An attorney reviews.
How long does sibling green card processing take?
Sibling green card processing time depends on the F4 category, for siblings of adult U.S. citizens. In October 2026 the F4 date for filing reached 1 November 2011 for most countries, and the line differs by country. Merit Law LLP compares your priority date with the chart.
How do I get a green card through marriage?
To get a green card through marriage, the U.S. citizen or permanent-resident spouse files Form I-130 ($625 online), and the foreign spouse adjusts status on Form I-485 or processes at a consulate. Citizens' spouses have no annual cap; permanent residents' spouses wait for a Visa Bulletin date. An attorney reviews.
What is the Form I-864 income requirement?
The Form I-864 income requirement is usually at least 125% of the HHS poverty guidelines by household size. For 2026 that is $27,050 for a household of 2 in the 48 contiguous states, per Form I-864P. Household members can add income on Form I-864A. Merit Law LLP reviews the sponsor's numbers.
Should I choose adjustment of status or consular processing?
Adjustment of status means applying inside the U.S. on Form I-485 ($1,440 on paper); consular processing means an immigrant visa abroad. Adjustment needs you to be in the U.S., eligible, with a visa available. A USCIS memo of 21 May 2026 calls it extraordinary, discretionary relief. An attorney reviews entry history.

Documents to prepare
- Proof of the petitioner's U.S. citizenship (U.S. passport or naturalization certificate) or green card
- Marriage certificate, and proof that any earlier marriage ended (divorce decree or death certificate)
- Birth certificates that show the relationship; Turkish civil records (for example a nüfus kayıt örneği) with certified English translations
- For a marriage: evidence the marriage is genuine, such as a joint lease or deed, joint bank accounts, photos over time and travel records
- The sponsor's latest federal tax return with W-2s and 1099s, recent pay stubs and an employer letter (Form I-864)
- Form I-864A for each household member whose income is counted
- In adjustment cases: the applicant's passport, I-94 and visa history, and the sealed medical exam (Form I-693) from a civil surgeon
- Court and police records for any arrest or charge, in any country
Common reasons for refusal or delay
- Using an old form: USCIS rejects Form I-485 editions other than 09/18/26 filed on or after 18 September 2026.
- From 1 October 2026 USCIS accepts only the 08/24/26 edition of Form I-864; it includes a credit-report authorization, so a credit freeze can delay review.
- A marriage petition without strong evidence the marriage is genuine; USCIS may interview, and since 5 August 2026 officers suggest DNA testing when primary proof of a genetic relationship is missing.
- Overstays, unauthorized work or other status violations: they bar many preference-category applicants from adjusting, and the May 2026 memo makes them weigh against discretion.
- Choosing both adjustment and consular processing on Form I-130, or leaving the choice blank.
- An approved Form I-130 gives no status by itself; USCIS may issue a Notice to Appear if the relative is removable.
- A child who turns 21 or marries can move to a different category; ask before a birthday or a wedding.
When this is not the right route
- The petitioner is a permanent resident and wants to sponsor a parent or sibling: permanent residents can petition only for spouses and unmarried children; see U.S. citizenship.
- A fiancé(e) abroad: the K-1 fiancé(e) visa (Form I-129F, $675) is a separate route.
- Fear of return or a pending removal case: see asylum and removal defense.
- A relative with a strong professional record in a long family line: an EB-1A or EB-2 NIW petition may avoid that wait.
Full details
Who this is for
- Spouses, parents and unmarried children under 21 of U.S. citizens.
- Adult sons and daughters and siblings of U.S. citizens.
- Spouses and unmarried children of permanent residents.
Key requirements
- A qualifying relationship, proved with civil documents, and a petitioner who is a U.S. citizen or permanent resident.
- Immediate relatives of U.S. citizens (spouse, unmarried child under 21, and parent of a citizen aged 21 or over) are not subject to the annual limit.
- The preference categories are F1 (unmarried sons and daughters, 21 or older, of citizens), F2A (spouses and unmarried children under 21 of permanent residents), F2B (unmarried sons and daughters, 21 or older, of permanent residents), F3 (married sons and daughters of citizens) and F4 (siblings of adult citizens). The priority date, the day USCIS received the I-130, sets the place in line.
- Family-sponsored preference visas are limited to 226,000 a year in general.
- The petitioner signs Form I-864 and must usually show income of at least 125% of the HHS poverty guidelines for the household, or add a household member's income on Form I-864A.
- Adjustment of status is discretionary. A USCIS memo of 21 May 2026 (PM-602-0199) tells officers that, where consular processing is available, a nonimmigrant's failure to depart as expected is highly relevant; family ties and other factors are weighed too.
- A new public charge rule applies to adjustment applications filed on or after 18 September 2026.
What to check with an attorney
- Which category you are in, because it decides the waiting line.
- Whether adjustment in the U.S. is available and sensible after the May 2026 memo, or consular processing fits better.
- Past entries, status history and any grounds of inadmissibility.
- How turning 21, marriage or the petitioner's naturalization could move you to another category.

Notes
- Dates are the October 2026 Dates for Filing chart that USCIS says to use for family adjustment applications; most countries includes Turkey and China. Mexico, the Philippines and, for F4, India have earlier dates. The chart changes every month. Typical times per USCIS. ↑
- Form I-864 income line: 125% of the 2026 HHS poverty guidelines is $27,050 for a household of 2 in the 48 contiguous states, per USCIS Form I-864P (effective 1 March 2026). The medical exam form (I-693) has no USCIS fee; the civil surgeon charges separately. Since 11 August 2026 USCIS may require online filing of a form after giving 60 days' notice. Attorney fees are quoted after a first conversation. ↑
